Nuapada: A 26-year-old man was sentenced to life in prison by the Additional District and Sessions Judge-cum-Special Judge (POCSO) court in Nuapada for raping his 15-year-old niece in 2019.
Tankadhar Bhoi was fined Rs 20,000 by ADJ Minakshi Das, and failing to pay will result in an additional one-year jail term. The survivor was also given Rs 6 lakh in compensation by the court, which the local legal services authority would pay.
In 2019, Bhoi, a resident of Chhata village under Khariar police jurisdiction, went to the minor's residence and committed the crime in the absence of her parents. He happens to be the girl's paternal uncle.
He warned her with grave consequences if she told anyone about the situation and paid frequent visits to the girl's home when her parents were away. As a result, the youngster became pregnant. The locals brought the mother's attention to the girl's growing tummy. After being questioned, the little girl described her ordeal, and a FIR was filed with the police on December 25, 2019. In January 2020, the victim gave birth to a newborn boy.
Police launched an inquiry and arrested Bhoi under Section 6 of the Protection of Children from Sexual Offenses (POCSO) Act of 2012, as well as Sections 376 (2) I 376 (2) (n), 376 (3), and 506 of the IPC.
Blood samples from the girl, her newborn, and Bhoi were taken and sent for DNA analysis. The child's DNA test revealed that the accused and the minor victim were the child's biological parents. In her decision, Judge Das stated that the prosecution was able to prove that the accused perpetrated repeated rape and aggravated penetrative sexual assault on the survivor while criminally intimidating her. Following the event, the gril was transferred to a government shelter house in Khariar, where she remains.
